Terms of Service

IMPORTANT: These Terms of Service contain a mandatory arbitration provision and a class action waiver in Section 19. Please read them carefully. By using YardHop, you agree to resolve disputes individually through binding arbitration rather than in court, and you waive your right to participate in class actions.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and YardHop LLC ("YardHop," "we," "us," or "our") governing your use of the YardHop mobile application (the "App") and website at yardhop.org (the "Site"), collectively referred to as the "Service."

By creating an account, accessing, or using YardHop, you agree to be bound by these Terms, our Privacy Policy (available at yardhop.org/privacy.html), and any additional policies referenced herein.

2. Eligibility

You must be at least 18 years of age to use YardHop. We verify this through a date-of-birth gate during account creation. You must have a valid mobile phone number capable of receiving SMS messages. Each person may maintain only one YardHop account.

3. Account Creation and Security

You are responsible for maintaining the confidentiality of your account, all activity under your account, and notifying us immediately of any unauthorized access. You may not create multiple accounts, share your account, or transfer it. Attempting to create a new account after suspension or termination ("ban evasion") is strictly prohibited.

4. The YardHop Platform

YardHop is a marketplace platform, not a party to transactions between users. We provide the technology that connects yard sale buyers and sellers. We do not own, create, sell, control, or deliver any listings or items. We do not guarantee the quality, safety, legality, or availability of any item listed on YardHop.

You acknowledge and agree that YardHop is not responsible for any disputes, claims, losses, injuries, or damages arising from transactions between buyers and sellers.

5. Selling on YardHop

The following items may not be sold on YardHop: weapons, firearms, ammunition, or explosives; counterfeit or stolen goods; recalled products; illegal items or controlled substances; wholesale or bulk commercial inventory. YardHop is for personal property only.

5.4 Seller Payments

To receive payments through YardHop Pay, sellers must complete Stripe Connect onboarding. Sellers receive the full listed price for every item sold — the processing fee is charged to the buyer. Payouts are processed weekly on Mondays. New sellers are subject to a 7-day hold on their first payout. A 10% rolling reserve is held for 30 days.

6. Buying on YardHop

6.1 All Sales Are Final

ALL TRANSACTIONS CONDUCTED THROUGH YARDHOP ARE FINAL. There are no returns, refunds, exchanges, or escrow.

Before making a payment, you are required to physically inspect the item(s) in person and confirm: "I have inspected this item in person and agree this sale is final."

6.2 Cash Payments

Buyers and sellers are always free to conduct transactions in cash outside of YardHop Pay. YardHop has no involvement in cash transactions.

7. YardHop Pay

7.1 Processing Fee

A processing fee of 3.5% + $0.35 is charged to the buyer on top of the item price. The seller always receives the full listed item price. The minimum transaction amount is $3.00.

YardHop uses a QR-code payment system. The seller enters an amount in the YardHop app and shows the buyer a QR code; the buyer scans it with their phone camera and pays through a secure Stripe-hosted web page. No buyer account is required. Payment links expire after 30 minutes if unused.

8. Chargebacks and Disputes

Chargeback liability is passed to the seller. If a buyer initiates a chargeback, YardHop will automatically submit GPS and transaction evidence to contest it. If upheld, the chargeback amount plus fees will be deducted from the seller's future payouts.

9. Reliability System

YardHop maintains a reliability score for every user, starting at 100%:

Strikes expire after 30 days. Score impact lasts 60 days and recovers at +2% per week. Repeated violations may result in account suspension.

9.1 Weather Exceptions

If a weather advisory is active at your sale location, you may reschedule without penalty. Canceling entirely during a weather advisory still carries the -15% penalty.

10. Community Sales

Community sales allow multiple sellers to organize together (Neighborhood Route or Central Meetup). A $2.99 fee applies to create an event (free for Repeat Seller subscribers). Only personal property may be sold. The organizer receives a -15% reliability penalty if they cancel.

11. Subscriptions

YardHop offers two optional paid subscription tiers. These are separate products — Repeat Seller does not include YardHop+ features.

11.1 YardHop+ ($2.99/month)

Unlimited Treasure Alerts, Pro Route Planner (10 stops), Live Buyer Count, Sale Address History, Price Drop Alerts, Priority Chat Badge, 1 free 24-hour boost per month, and exclusive teal app icon.

11.2 Repeat Seller ($7.99/month)

5 free 24-hour boosts per month, up to 30 item photos per sale, instant deposits (1% fee), advanced analytics, PRO badge, priority support, and free community sale organizing.

11.3 Billing

Subscriptions are billed monthly through Apple's In-App Purchase system. They auto-renew unless canceled at least 24 hours before the end of the billing period. Manage or cancel through Apple ID settings. No refunds for partial billing periods.

12. Boosts

Boosts are non-refundable. If your listing receives reports while boosted, the boost may be paused.

Keep all transaction communication on-platform. Do not share personal contact information. Do not request off-platform payments. Do not send threatening or abusive messages. Automated keyword detection displays safety warnings. You may block any user.

15. Intellectual Property

The YardHop name, logo, bunny mascot, and tagline ("Deals worth hopping for.") are property of YardHop LLC. You retain ownership of content you create on YardHop. By posting content, you grant us a non-exclusive license to display it in connection with operating the Service. This license ends when you delete your content or account.

16. Prohibited Conduct

You agree not to: use YardHop for unlawful purposes; post false or misleading listings; manipulate prices, ratings, or the reliability system; create multiple accounts; use automated tools or scrapers; circumvent security features; use YardHop Pay on jailbroken devices; engage in collusion or fraud; harass other users; solicit transactions off-platform; reverse-engineer the App; sell prohibited items.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YARDHOP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, ANY TRANSACTIONS BETWEEN USERS, OR ANY ITEMS PURCHASED OR SOLD.

YARDHOP'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO YARDHOP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

18. Indemnification

You agree to indemnify and hold harmless YardHop LLC from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or any transaction with another user.

19. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

19.1 Informal Resolution

Before filing any formal dispute, contact us at support@yardhop.org. We will attempt to resolve the dispute within 30 days.

19.2 Mandatory Binding Arbitration

Any dispute not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association in Clark County, Washington. The arbitrator's decision is final and binding.

19.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

19.4 Opt-Out

You may opt out of arbitration by sending written notice to support@yardhop.org within 30 days of creating your account. The class action waiver in Section 19.3 still applies.

20. Termination

You may delete your account at any time through Settings. We may suspend or terminate your account for violation of these Terms, fraudulent activity, excessive chargebacks, repeated low reliability scores, harassment, or ban evasion.

21. Governing Law

These Terms are governed by the laws of the State of Washington, United States. Any lawsuits permitted under these Terms shall be in Clark County, Washington.

22. General Provisions

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and YardHop. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent.

23. Changes to These Terms

We may modify these Terms at any time. Material changes will be notified at least 30 days before taking effect. Continued use constitutes acceptance.
